General terms of business Please, give to these general terms of business The achievements of Pegasus Models are produced exclusively on the basis of these general terms of business. We do not recognise standing in the way or from our conditions divergent general conditions. 1. Reservation expiry and contractual relationship (1) The sending of an inquiry to Pegasus Models – in writing, by on-line form or by email – shows only one establishment of contact or reservation inquiry. This process is looked on the part of Pegasus Models NOT as an obliging reservation. (2) Pegasus models gets in contact after the reservation inquiry first with the Escort lady and afterwards with the customer. Pegasus models informs the customer whether and when the Escort lady are available. Also the details of the reservation or necessary changes are discussed with the customer. (3) As soon as the parties have come to an agreement about the duration, way of the service, a confirmation of sides Pegasus models occurs, mainly by email or in hasty cases by phone. (4) For the case of a reservation exclusively a contractual relationship comes about between the Escort to lady and the customer. Besides, Pegasus models acts merely as a mediator. (5) For reasons of the discretion the contact and the contract winding up take place beyond the agreed appointment, nevertheless, exclusively between Pegasus Models and the customer. This is also valid for the case that one of the contract-closing parties withdraws from the contract or discontinues this. Pegasus models was authorised in this respect to the Vornahme of suitable actions on the part of the Escort ladies. Also a monetary receipt authority is given on the part of from Pegasus Models. 2. Disclaimer of liability Pegasus models assumes no liability for damages which originate to the customer on account of between the customer and the Escort lady of resulted contractual relationship from actions of the Escort lady. In particular Pegasus models does not stick for health defects, the quality from the Escort lady to achievements to be produced as well as for other contractual, deliktische or other claims of the customer which are to be led back on the relation between customer and Escort lady. 3. Price (1) The prices for from the Escort lady to offered achievements are to be found under the point Fee with the Setcards of the single Escort ladies. (2) The fee prices applying with the reservation are valid. (3) In addition, travel expenses can arise, provided that the Escort lady must arrive to a place certain by the customers. You find a listing of these prices also with the Setcards of the single Escort ladies. (4) Costs for flight tickets and road maps are proved individually after destination, season and reservation terms. If the costs increase after end of the reservation for flight tickets or road tickets so the customer carries this rise. 4. Method of payment (1) The payment occurs, untill otherwise agrees by contract, in cash by handing over of an open envelope by the customer to the Escort lady at the beginning of the engagement. (2) From a reservation duration of 3 days or in the case in which the Escort lady need a longer journey to the place desired by the customers (by the car, the road or by the airplane) is a deposit of 50% of the fee on the commercial discount payment of Pegasus Models (bank connection: Hypocooperative bank, account No. 663906240, account holder Pegasus models; bank code number 700 202 70;) necessarily. A suitable monetary receipt authority is given on the part of Pegasus Models. (3) On credit card payments the debit of the credit card occurs under the name "Pegasus of models". The credit card is loaded immediately after order delivery. (4) The appointment is obliging in cases of paragraph 2 after entrance of the deposit on the commercial discount payment of Pegasus Models. (5) With reservations, e.g., from flight tickets by Pegasus Models, the travel price is to be transferred to begin with to the commercial discount payment of Pegasus Models, so that Pegasus can carry out models the final reservation of the tickets. 5. Reservation lengthening (1) If the customer wishes a lengthening during a running company, he arranges this possibility directly with the concerning Escort lady. The approval with the desired lengthening lies in own judgement of the Escort lady who will get in contact accordingly with Pegasus Models. (2) The costs for the lengthening are to be paid in cash directly to the Escort lady. 6. Transfer posting (1) By request of the customer and in urgent cases of the prevention Pegasus carries out models, as far as practicable, a change of the reservation of the customer. Nevertheless, a claim of the customer on transfer posting does not exist. (2) A transfer posting can occur only if the customer Pegasus models informs at least 24 hours before the beginning of his engagement over here in writing or by telephone. (3) If the reservation duration amounts 3 days or more, the notification has to occur at least 48 hours before the beginning of the engagement. (4) Pegasus models carries out the reservation of flight tickets and road tickets, as far as possible, with a cancelation protection. As far as the cancellation or transfer posting causes, nevertheless, costs, these costs are to be born completely by the customer, provided that this has to represent the cancellation or transfer posting. 7. Cancellation (1) If the customer at least 24 hours before the beginning of his engagement calls off this for important reason, an already made deposit of the fee is paid back. If the reservation duration amounts 3 days or more, the cancellation has to occur at least 48 hours before the beginning of the engagement. (2) With a refusal which occurs less than 24 or 48 hours in advance a possible deposit remains with Pegasus Models for the cover with Pegasus Models of resulted costs, unless, the customer proves a lower expense. The figures 9 and 10 these terms of business are valid for the cases of the resignation or the notice. (3) Pegasus models carries out the reservation of flight tickets and road tickets, as far as possible, with a cancelation protection. As far as the cancellation causes, nevertheless, costs, these costs are to be born completely by the customer, provided that this has to represent the cancellation. As far as the customer books the tickets for the Escort ladies, he commits himself to the end of a travel resignation costs assurance. 9. Resignation of the reservation by Pegasus Models (1) Pegasus models and the Escort ladies aim after the best skill at the best possible achievement to the satisfaction of the customer. (2) Provided that the booked Escort lady for important reason, as for example illness or accident, are prevented from perceiving the appointment, Pegasus will suggest models as far as possible a spare lady. If the customer rejects this spare lady, have went out any claims to the achievement. A deposit on the fee by the customer is transferred to this immediately back. In this case Pegasus models or the Escort lady carry for the selfkeeping of the cancelation costs for the flight or road ticket of the Escort lady, as far as the customer has taken out a travel resignation costs policy. In addition, going costs are to be born by the customer themselves. (3) Other claims for damages of the customer are excluded, provided that these do not concern damages on account of the injury of the life, the body or the health or are based on a roughly careless or deliberate duty injury of the Escort lady. (4) The Escort lady or Pegasus models can withdraw without observance of a term from the reservation if the realisation of the appointment is disturbed by the customer with lasting effect. The same one is valid if the customer behaves in strong measure contrary to the terms of the agreement. In this case no costs are substituted and the Escort lady or Pegasus models withhold on a deposit of 50% on the fee this amount as a substitute of own expenditures. Nevertheless, the customer can prove that a damage is not occurred at all or that he is substantially lower, than the withheld sum. 10. Unusual circumstances – force majeure (1) If an appointment and in particular a trip is considerably complicated as a result of higher power, is endangered or affected, the customer as well as the Escort lady or Pegasus can cancel models the reservation. (2) Force majeure encloses all events which lie beyond the control of the parties to a contract and which make the other fulfilment of the contractual obligations impracticable or to the parties to a contract economically impossibly, have in particular natural phenomena, war actions, government decisions, blockades, revolution, strikes, exclusions, boycott, embargoes, civil war, terrorist attacks or other events, the disadvantageous influence on the trip as well as cases to be treated as equal. (3) Pegasus models pays back in the cases of higher power the deposit immediately, nevertheless, can require for produced or still compelling to achievements to be produced an adequate compensation which correspond to the actual expenditures of Pegasus Models or from the Escort lady. 11. Data protection (1) All personal data are protected according to the data protection-juridical regulations, in particular to the federal data protection act. (2) The delivery within the scope of the website from "www.pegasus-models.de" by the customer to given and sent personal data expressly occurs on voluntary base. (3) The personal data are processed exclusively for the realisation of the reservation and are used. The data are not transmitted into three parts. 12. Legal venue arrangement Legal venue for independent commercial agents, for the people who have no general legal venue by the home, as well as for people who have moved her residence or usual place of residence after end of the contract abroad or their residence or usual stay at the time of the complaint elevation is not known, is the seat of Pegasus Models, Munich. 13. Severability clause The ineffectiveness of single regulations of these terms of business does not entail the ineffectiveness of the whole terms of business.
